Terms of Service
Effective: January 1, 2026
These Terms of Service ("Terms") govern your access to and use of iPentest's website and security testing services ("Services") provided by iPentest LLC ("iPentest", "we"). By using the Services, you agree to these Terms.
1. The Services
iPentest provides AI-powered and expert-led penetration testing and security assessment services. The specific scope, deliverables, and timing for each engagement are described at the time of purchase or in a separate statement of work.
2. Authorization and ownership of targets
You may only submit targets, including domains, IP addresses, applications, accounts, and other digital assets, that you own or are explicitly authorized to test. By submitting a target, you represent and warrant that you have all rights and authorizations necessary to permit security testing of that target.
3. Acceptable use
You agree not to use the Services to: (a) violate any applicable law or regulation; (b) infringe the rights of others; (c) attempt to disrupt, reverse engineer, or gain unauthorized access to iPentest's systems; or (d) test any asset you do not own or are not authorized to test. We may suspend or terminate access for any violation.
4. Payment
Fees are due in advance for the package you select and are processed by our payment provider. Unless stated otherwise at the time of purchase, fees are non-refundable once testing has begun. Recurring or annual plans renew automatically until cancelled.
5. Reports and confidentiality
We deliver findings as a written report. You are responsible for keeping reports confidential and using them only to remediate the issues identified. We treat the information you share with us as confidential and will not publicly disclose specific findings tied to your organization without your consent, except as required by law.
6. Intellectual property
iPentest retains all rights to its methodologies, tools, software, and platforms. Subject to your payment of applicable fees, you receive a non-exclusive, non-transferable right to use the report we deliver for your internal security purposes.
7. No guarantees
Security testing reduces but does not eliminate risk. We do not warrant that we will identify every vulnerability or that any system tested is free of defects. The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, iPentest's total liability for any claim arising out of or relating to the Services is limited to the fees you paid to iPentest in the twelve (12) months preceding the event giving rise to the claim. iPentest is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits or business interruption, even if advised of the possibility of such damages.
9. Indemnification
You agree to defend, indemnify, and hold harmless iPentest, its affiliates, and their respective officers, employees, and agents from any claim, loss, or expense arising out of (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) your submission of any target you did not own or were not authorized to test.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms or if continued service is no longer commercially feasible. Sections that by their nature should survive termination (including Sections 5 through 11) will survive.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts of the State of Wyoming, and you consent to the jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. The "Effective" date at the top will reflect any changes. Continued use of the Services after the new Terms are posted means you accept the updated Terms.
